An estate plan can avoid probate in several ways, the most common one would be to use a revocable trust so assets are owned in that trust and when the individual passes away, the assets pass to the beneficiaries through the terms of that trust and avoid going to court. There are also joint ownership and naming beneficiaries on accounts with banking institutions where they distribute the assets by contract to those individuals.
